This Privacy Policy (“Privacy Policy”) is effective as of the date listed above. This Privacy Policy describes the types of information that Denver Commercial Property Services, Inc. and its affiliated entities (“DCPS”, “we”, “our”, or “us”) may collect from you (“you” or “your”) or that you may provide through denvercps.com, excelcapitalprojects.com, integrated-cleaning.com, and any of our other websites (collectively, the “Site”), and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information (as defined below). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it. The suite of products and services offered by DCPS, including the Site, are referred to in this Privacy Policy as the “Services.”
This Privacy Policy is a legally binding agreement between you and DCPS. If you are entering into this Privacy Policy on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Privacy Policy, in which case the terms “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Privacy Policy, then you must exit the Site immediately and cease all access and use of the Site. By accessing and using the Site, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.
You acknowledge and agree that this Privacy Policy does not apply to any Personal Information you choose to make public.
Because DCPS provides Services to residential and commercial real estate property owners and property or facility managers (together, “Clients”), DCPS has no direct relationship with the individuals with whom our Clients may conduct business or transact, and from whom our Clients may collect or receive personal data, which is information that is linked or reasonably linkable to an identified individual. DCPS processes limited personal data.
If you have any questions about the data practices of a Client that uses the Services and which may process your Personal Information, please contact the Client (i.e., your property or facility owner or manager) directly. Contact information for the applicable Client may be found in your lease or homeowners association documentation.
The Site may contain links to third-party websites, which you may voluntarily visit at your discretion. The information practices of such other websites are governed by the privacy statements or policies of those other websites. DCPS encourages you to review the privacy statements or policies of those websites to understand their information practices.
Categories of Personal Information. We Collect and Sources of Information
All information that can be directly or indirectly used to identify you is referred to as “Personal Information.” The categories of Personal Information we collect and/or process are set out below:

Purposes for Collection and Processing
We act in the capacity of a data controller when we ask you to submit your Personal Information that is necessary to ensure your access and use of the Site. In such instances, we are a data controller because we determine the purposes and means of the processing of Personal Information.
In order to make the Site available to you, or to meet a legal or regulatory obligation, we may collect and use certain of your Personal Information. If you do not provide the Personal Information that we request, we may not be able to provide you with full access to all of the features of the Site. We use Personal Information to perform Services for our Clients and enhance our Site, including to:
- Respond to requests for information and questions. For example, to respond to your requests for information about our Services. We may also use Personal Information to communicate with you about our Services or your use of the Site, including to confirm your identity.
- Develop, provide, deliver, and improve the Site and our Services. For example, to refine and improve the Site such as to add new features and improve the Client experience, or to conduct internal research to make such improvements.
- Provide you with Services. For example, to deliver our Services either for or on behalf of our Clients, including to identify individuals associated with a current Client.
- Market, promote, and conduct advertising for the Services. For example, we use Personal Information to send marketing communications via email or other methods, where you have not opted out of such communications.
- Operate, maintain, secure, and improve current and future Sites. For example, to understand data about Client use of the Site and Services and to learn about the Site’s performance and identify areas for improvement.
- Comply with any procedures, laws, and regulations which apply to us or our processing. For example, we comply with subpoenas and other court orders to process data where we have determined there is a legal requirement for us to do so. We may provide information to government gaming authorities or agencies as required by applicable law and in relation to their investigations.
- Establish, exercise, or defend our legal rights. We may process your Personal Information in connection with establishing, exercising, or defending our legal rights where it is necessary for our legitimate interests or the legitimate interests of others or for fraud prevention. For example, we may process information you provide to identify any fraudulent, harmful, unauthorized, unethical or illegal activity such as use of another individual’s identity and we may use Personal Information as necessary to defend ourselves in litigation or enforce our rights or agreements with others.
- Conduct recruiting and hiring activities. We will review the information you submit to determine if your qualifications and experience match any available opportunities, to conduct background checks, and verify the information you provide, communicate with you regarding any opportunities, improve our recruiting processes, process your onboarding if hired, and comply with applicable labor and employment laws.
Automatic Collection of Information
When you open the Site, our servers automatically record information that your browser sends. This data may include but is not limited to information such as your browser type and version, operating system type and version, language preferences, geographic location, the webpage you were visiting before you came to the Site, pages of the Site that you visit, the time spent on those pages, information you search for on the Site, access times and dates, and other statistics.
Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Site. This statistical information is not otherwise aggregated in such a way that would identify you in particular.
Internet Protocol Address
All computers and servers on the Internet use Internet Protocol (“IP”) addresses to recognize and communicate with each other. We collect and maintain IP addresses to administer and analyze our Site and report aggregate information.
We may associate your IP address with your personally identifiable information and may maintain, use, and disclose such information in accordance with the terms of this Privacy Policy.
Disclosure and Processing of Personal Information
DCPS does not share, sell, rent, or trade Personal Information with third parties for their promotional purposes. We may share Personal Information with our subsidiaries and affiliated companies that assist us in providing Services; subcontractors and other third-party service providers, including to prevent fraud and protect the rights, property, safety, or security of our business, third parties, visitors to our websites and mobile apps, or the public; auditors or advisers of our business processes; governmental authorities or other law enforcement pursuant to legal process. We may disclose any Personal Information we collect, use or receive if required or permitted by law, such as to comply with a subpoena or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may also share Personal Information with potential or actual purchasers or investors in our company. Specifically, we may share Personal Information with any company that acquires, or considers acquiring, our company or assets.
How we process your Personal Information depends on how you interact with the Site, where you are located in the world and if one of the following applies: (i) you have given your consent for one or more specific purposes; (ii) provision of Personal Information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which you are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party. We may also combine or aggregate some of your Personal Information in order to better serve you and to improve and update our Site.

Please indicate if you are acting as a representative of another individual. If that is the case, include the identification information both for yourself and for the individual you represent and a copy of the written authorization you have received.
Please note that most of the Personal Information DCPS collects and maintains is on behalf of Clients, as a service provider to those Clients. As a result, the privacy policy of each Client, and not this Privacy Policy, covers those companies’ use of some Personal Information. Therefore, if you make a request to us with respect to such data, we may refer you to the Client (for instance, property management companies) to whom you may direct your request.
Communications Preferences
If you provide contact information through the Site, then you consent to DCPS using the information that you have provided to respond to your inquiries. To the extent we engage in marketing communications, you may manage your receipt of marketing communications by clicking on the “unsubscribe” link located on the bottom of DCPS’s marketing emails. Client representatives cannot opt out of receiving transactional emails related to their account with DCPS or the Services.
Data Retention
DCPS retains the Personal Information we receive for the duration of your relationship with DCPS, and where we have an ongoing legitimate business need to do so (for example, to comply with applicable legal, tax or accounting requirements, to enforce our agreements, resolve disputes, or comply with our legal obligations). Retention periods may be extended if we are required to preserve your Personal Information because of litigation, investigations and other similar proceedings, or if a longer retention period is required or permitted by applicable law.
When we have no ongoing business need to maintain or process Personal Information, we will either delete or anonymize such data to the extent practicable. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.
Cookies
The Site may use Cookies. “Cookies” are small text files that allow websites to store and retrieve information about you from your computer system. Cookies are served to track individual site usage for later aggregation and for other purposes explained in this Privacy Policy. You are always free to decline our Cookies if your browser permits, but you may not be able to take full advantage of our Site features if you do.

Our Site may use third-party analytics tools that use Cookies, web beacons, or other similar information-gathering technologies to collect standard internet activity and usage information. Do Not Track Signals

DCPS is committed to protecting the security of any Personal Information we control or process. DCPS uses administrative, technical, and physical security measures designed to protect any such Personal Information. Despite these protections, no electronic transmission over the Internet or information storage technology can be guaranteed to be completely secure, so you should take appropriate precautions before deciding what information you send us in this way. We do not ensure, warrant, or guarantee the security or integrity of such Personal Information. We will not be responsible for disclosure of any information (including Personal Information) due to errors in transmission or the unauthorized acts of third parties.
Data Breach
In the event we become aware that the security of any Site has been compromised or your Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law.

DCPS reserves the right to change this Privacy Policy from time to time. Your continued use of any Site after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates. If we make a material change in the way we use or share your Personal Information, we will provide notice that our policy has changed on this Site.
